    Where, on inspection, it is determined that any ship detained under section 392 was not an unseaworthy ship, the expenses in connection with the inspection shall be paid to the Minister by the person making the complaint, and the payment does not prejudice any right of suit or action against the complainant by any persons aggrieved by the complaint.
