If a person who is served with a notice of violation makes representations in accordance with the notice, the Minister must decide, on a balance of probabilities, after considering those representations, whether the person committed the violation and, if the Minister so decides, the Minister may impose the penalty set out in the notice, a lesser penalty or no penalty.
